13-year-old boy murdered in Chicago...shot 22 times

In what appears to be a case of mistaken identity, on Wednesday night, a 13-year-old boy was shot at least 22 times by a masked gunman. The killer emerged from a darkened, overgrown vacant lot and pumped round after round into rising eighth-grader Robert Freeman Jr. while he was riding his bike.

The boy's father, Robert Freeman Sr., told the Chicago Sun-Times: "My son was the only one got hit. I don't understand how no one seen anything."

As usual, witnesses are not cooperating, and this murder is likely to go unsolved. Chicago is suffering a wave of gang violence which was responsible for nearly all of the city’s 458 murders last year.

Here locally, Newport News is experiencing a surge in murders this year due to gang violence as well. While the numbers are not even close to those being seen in Chicago, two 9-year-olds have been shot in the city this year, with the latest coming on Tuesday in a drive-by shooting.

Fortunately, that boy survived.

Just as in Chicago, Newport News police have been frustrated by the “no snitching” code which keeps dangerous criminals on the streets, and their neighbors who refuse to identify themâ€"prisoners in their own homes.

On Wednesday, a fed up Newport News Police Chief James Fox pleaded with the residents of the East End community where most of the shooting have taken place, to work with them.

Chief Fox said: "Give us some information about who is doing the shootings. It helps us get that little piece of the puzzle to get that person off the street."

Immigration Customs Enforcement agents have concluded a two-month operation, resulting in the arrest of 87 criminal aliens throughout Virginia and Washington D.C.

According to Henry Lucero, director of the Washington Field Office for ICE, many of the fugitives were taken into custody in central and southern parts of the state, while the majority of the arrests took place in Northern Virginia.

Lucero said that 28 of the foreign nationals were “level one” criminals, and previously convicted of very serious crimes.

Those arrested included armed robbers, drug dealers, sex offenders, and MS-13 gang members.

A press release issued by ICE lists the following details on three of the apprehensions:

“-Jorge Garcia-Alberto, 46, a Honduran national, who illegally re-entered the United States after being previously removed. He was arrested in Herndon, Va., on a criminal warrant for re-entry. His criminal history includes felony convictions for sale of marijuana, as well as misdemeanor burglary, theft and DUI. Garcia-Alberto is in ICE custody and may face criminal prosecution for re-entry to the United States.

-Oscar Montoya, 30, an El Salvadoran national, an immigration fugitive and a member of MS-13. He was arrested in Centreville, Va., for immigration violations. His criminal history includes felony drug convictions. He is in ICE custody pending removal from the United States based on an outstanding order from the immigration judge.

-Robert Cummings, 49, of Guyana, a legal permanent resident of the United States, was arrested in Richmond for immigration violations. His criminal history includes felony convictions for possession of a weapon and intent to distribute cocaine. He has been placed in removal proceedings.”

Execution date set for Virginia's only female death row inmate

On Thursday, a September 23 execution date was scheduled for Theresa Wilson Lewis. In 2003, she pleaded guilty to masterminding the October 2002 murders of her husband and stepson in Pittsylvania County.

In early June, the 4th U.S. Circuit Court of Appeals decided against Lewis, Virginia’s lone female death row inmate.

In March, her lawyers told the federal appeals court that her death sentence should be rescinded because her drug addiction and alleged personality disorders were not considered at her trial.

At her 2003 sentencing, Circuit Court Judge Charles Strauss addressed Lewis, telling her that she was a cold, emotionless killer, and was motivated solely by financial reasons. She was actually given two death sentences, plus 53 years.

Prosecutors said that Lewis boasted to friends that she had married Julian Lewis Jr., simply for money and offered sex to the two men who carried out the murders. She was to be the sole beneficiary of $250,000 in insurance money.

Lewis, not only offered herself to the hired hit men, but her 16-year-old daughter as well. She left a door unlocked, and sat by as her husband and stepson were gunned down, waiting an hour to call 911.

Both men were shot multiple times with shotguns.

In a scene which can only be described as sickening, Lewis actually went through her husband’s pockets, as he lay dying, gasping for air.
A deputy sheriff testified that when he arrived on the scene, Julian Lewis was still alive, and told him: “My wife knows who done this to me.”

The gunmen, Rodney Fuller and Matthew Shallenberger, were both sentenced to life in prison. Shallenberger committed suicide in 2006 at Wallens Ridge State Prison.

Lewis' daughter, Christie Lynn Bean, who knew about the plot but kept quiet, also served time in prison.

Lewis’ current attorney, James Rocap, claims that his client was not capable of plotting the murders due to her severe dependency on prescription drugs, as well as a personality disorder which rendered her overly dependent on men.

He also says that Lewis has developed a “deep faith and deep remorse for the crimes.”

Rocap says he is planning to appeal the case to the Supreme Court, as well as file for clemency with Gov. Bob McDonnell. He told reporters: “We were obviously disappointed in the result and intend to vigorously pursue all avenues on Teresa's behalf.”

If executed, Lewis will be the first woman to die in Virginia’s death chamber since 1912, when 17-year-old Virginia Christian died in the electric chair, after smothering her elderly employer with a pillow.

Since 1900, only 50 women have been executed in the United States, with the last one taking place five years ago in Texas.

Since the reinstatement of the death penalty in 1976, Virginia has carried-out 107 executions.

Murdered toddler was covered in bite marks

More details are emerging in the grisly murder of 17-month-old Jireh Jahsean Gayles, who was killed on Tuesday at his mother’s Newport News apartment. According to an affidavit, he had “several overlapping, human bite marks on his upper torso to include the stomach, chest and diaphragm area, as well as his legs and back.”

The toddler also had wounds which appeared to have been sustained from a “clamping device with teeth.”

On Thursday, Newport News police arrested Darius Brown, 22, and charged him with the murder of his girlfriend’s 17-month-old son. He was watching the little boy while his mother was at work.

According to the arrest warrant, Brown called 911 and when officers arrived at the Aqua Vista Apartments, they found the child ”lying face up on the bed, unresponsive, cold to the touch and had no pulse.”

Brown told police that the child became “unsteady on his feet, falling asleep and not being able to stay awake.”

Police said there were obvious injuries on the boy’s tiny body. The cause of death is listed as head trauma and blunt force abdominal trauma.

While court documents indicate Brown refused to answer the officer’s question, as to when he last saw the child, the following disturbing events were recorded in the report: [Brown] “had taken videos of the child…showing how the child had been acting and was insistent that Officer T.E. Byers review them. Officer T.E. Byers observed the videos depicting the child, J.G. 01-29-2009 unsteady on his feet and falling to the ground. Officer T.E. Byers continued watching the videos and the condition of child, J.G. 01-29-2009 to worsen with each video.”

The video, was taken on Brown’s cell phone.

The boy’s 5-year-old sister was also home at the time, and told police she saw “Darius punch, kick and bite Jireh.” The girl was unhurt.

Brown is being held in the Newport News City Jail on one count of murder and four counts of malicious assault.

Heartless attacker says of 87-year-old victim: "She already old" (w/video)

On Monday, Remone Jilantai Houchens, 19, who is accused of breaking into a home on May 22, and brutally beating an 87-year-old grandmother, appeared in a Louisa County courtroom for a preliminary hearing. His trial is set to start in early December.

The victim, Lois Rosson, was punched in the face repeatedly, and left blind in one eye. Prosecutors allege that Houchens also groped the woman and licked her face.

Houchens, an alleged member of the Bloods street gang, has given police two conflicting accounts of the crime.

Houchens originally told investigators that he was running from Crips gang members and simply “fell through” Rosson’s door. He also told Louisa County Sheriff’s Detective Scott Renalds that he never hurt Rosson.

According to the interview transcript, Houchens said: “And you got to believe, and this from the bottom of my heart. I wasn't in the house to hurt no one. I promise.”

He continued: “I kept saying -- I was like, 'Look. I'm not going to hurt you. I'm just trying to' -- but she won't -- it was like she wasn't hearing me.”

Houchens claimed Rosson fell and hurt herself.

Four days later, he told detective Lt. Howard Porter a different story.

Houchens told Porter that he and a friend broke into Rosson’s home with the intention of burglarizing the property, and his supposed cohort “pushed her over.”

Houchens said: “It was basically in and out, but really, I helped her up and told her I wasn't there to hurt her, you know.”

“She already old,” he said. “You won't -- you can blow her over. You know what I'm saying? And that's not my style. Anybody know that's not my style.”

When he was taken into custody, Houchens clearly had cuts and bruises on his knuckles and a scratch on the side of his face.

Houchens is charged with felony aggravated malicious wounding, robbery and burglary with the intent to commit robbery.

DNA evidence linked Houchens to the crime scene, as he apparently cut himself on broken glass in Rosson’s home.

At the time of the assault, Houchens was already free on bond on a felony charge of having carnal knowledge of a 13-year-old child.

Photos of "bottle bomb" suspects released, investigators ask for public's help

Virginia Beach Fire Department investigators have just released security camera images of three suspects in a string of serious vandalism incidents in which makeshift “bottle bombs” were used.

VBFD Battalion Chief Tim Riley said the surveillance images show three males purchasing the materials they used to make the explosive devices.

The incidents occurred between June 6 and July 13 and resulted in explosions in the Great Neck, Shorehaven and Upper Chelsea areas of Virginia Beach. While no injuries have been reported, Chief Riley says arson investigators "believe the suspects' behavior may escalate to more serious incidents."
