Drunk driver who left girlfriend in flooded car gets prison sentence

On Friday, Michael Brandon Walck, 23, who drove his car into a ditch last October in Virginia Beach, and fled the scene with his injured girlfriend trapped in a vehicle quickly filling with water, was sentenced to two and a half years in prison.

For the DUI, Walck actually received a year’s sentence, and five years for felony hit and run, but the judge suspended three and a half years of that sentence.

Walck was driving on Sandbridge Road, after a night of drinking when he lost control of his car and ran into a ditch.

According to police, he then ran from the scene, leaving his girlfriend in waist-deep water. It took an hour for firefighters to extract her from the car. She was taken by helicopter to Sentara Norfolk General Hospital with a leg injury.

Police found Walck a short time after the accident.

Frustrated...families of Colonial Parkway murder victims turn to private investigators for answers

On Saturday night, a fundraiser was held at the Candle Light Kitchen in Toano, to raise money to hire a team of private investigators, many hope can finally solve the Colonial Parkway Murders. It is the first of many such planned events.

More than 20 years after the last murders (at least officially) occurred in the case, the FBI has yet to solve even one of the crimes.

In January, the FBI announced that they were reopening the case, using new DNA testing. The victims’ families are still waiting for those results.

Frustrated with the lack of progress, the families hope to discover who killed their loved ones on their own. Joyce Call, the sister of one of the victims, told the Daily Press: “There's a murderer out there and he deserves to be held accountable.”

Between 1986-1989, there were eight bodies found at different points along Virginia’s Colonial Parkway. They were all killed in pairs, they were all young, and in some of the cases, the victims’ car was found with the driver’s side window rolled partially down, leading to speculation that the killer was either a police officer or security guard, or someone posing as such.

The case which has come to be known as the Colonial Parkway Murders has never been solved.

On October 12, 1986, the bodies of Cathleen Thomas, 27, and Rebecca Ann Dowski, 21, were found in Thomas' Honda Civic, at the bottom of an embankment along the Parkway. Their throats had been slashed.

In September 1987, David Knobling, 20, and Robin Edwards, 14, were discovered murdered at the Ragged Island Wildlife Refuge, on the James River. The bodies were found by Knobling's father.

On April 9, 1988, Cassandra Lee Hailey and Richard Keith Call were reported missing after attending a party in Newport News. It was their first date. Call's car was found on the Colonial Parkway the next day. Their bodies have never been recovered.

In October 1989, the bodies of Anna Marie Phelps, 18, and Daniel Lauer, 21, were found by hunters in the woods of New Kent County near a rest stop on Interstate 64. They had been missing for nearly a month.

Virginia State Police wrote 4,000 tickets this past weekend

During their latest effort in the ongoing statewide safety campaign, known as “Operation Air, Land & Sea,” Virginia State troopers wrote 2,157 speeding tickets as well as 394 reckless driving violations. They also issued many citations for DUI and safety belt violations.

According to State Police Superintendent W. Steven Flaherty, last weekend was the fifth this year in this saturation effort designed to make Virginia’s highways safer.

As Labor Day weekend approaches, Virginia drivers can expect to see even more stepped up patrols.

Chesapeake police officer arrested for sex charges involving a minor

On Monday, Officer Michael Boyd, 31, was arrested for sending nude pictures of himself to someone he believed to be a 16-year-old girl. The girl turned out to be a detective.

An investigation of the officer began a week ago with a tip from a concerned citizen.

The detective texted Boyd pretending to be a 16-year-old girl named Brittany. According to court documents, Boyd then sent the girl nude pictures of himself, in hopes that she would do the same.

Boyd is free on $7,500 bond and has been suspended without pay from the police department.

Two HRT employees charged with stealing $80,000 in bus fares

On Wednesday, Latasha Boyd, 22, of Virginia Beach and Karen Watkins, 23, of Portsmouth turned themselves into police after both were indicted by a grand jury for stealing $80,000 from Hampton Roads Transit bus fare boxes.

Both women began working for HRT in 2008, and have been charged with embezzlement, money laundering, and tax evasion.

According to Virginia Beach Commonwealth’s Attorney Harvey Bryant, Boyd and Watkins started stealing the fares in early 2009.

Bryant told WTKR: "Their official title at the time was vault pullers and their duties were to go down to a location in Virginia Beach and get the money that came off of the buses, the cash money, and to take that back to Norfolk to be counted."

None of the $80,000 has been recovered.

Boyd is free on a $50,000 bond, while Watkins is still being held in the Virginia Beach Jail. If convicted, both defendants face up to 70 years in prison.

Woman found with goat tied-up in trunk of her Mercedes...guilty of animal cruelty

Bedford County General District Court Judge Harold Black has found a woman guilty of animal cruelty, after she was arrested in June with a goat in her hot trunk.

The woman, Fiona Enderby, 32, of Washington, D.C., was stopped at a sobriety checkpoint by Bedford County sheriff's deputies, who heard loud knocking sounds coming from the trunk of the woman’s Mercedes. When it was opened, the deputies found a goat, hogtied and struggling for his life.

Enderby told deputies that she had purchased the goat for the four Kenyan immigrants in her car.

The goat was in obvious distress, foaming at the mouth and given the hot temperature, surely would have expired soon, had the deputies not intervened.

According to Maj. Ricky Gardner of the Bedford sheriff's office, the temperature in the trunk registered at 94 degrees, ten minutes after it was opened.

Judge Black sentenced Enderby to 10 days in jail and a $500 fine, but suspended all of the jail time and $400 of the fine.

The goat is now living at the Peaks of Otter Winery/Johnson's Orchards in Bedford County.

Owner, Danny Johnson told WSET 13: “I would say he's having an excellent life. He eats well. He has everything he could ask for. We named him ‘Trunk,’ because we thought that was very appropriate since he came out of the trunk of a car. We just call him ‘Trunk.’”

Johnson continued: “He's having a wonderful time, and I expect some time in February he's going to be a daddy.”

City driver who killed homeless man was accident waiting to happen

On June 28, a homeless man, Michael Knockett, 52, who was sleeping on the beach, was run over by a Virginia Beach city dump truck. The truck’s crew was emptying trash cans along the beach, as they do every morning.

Heather Boyd, the city driver who crushed the man, has a driving record that has many questioning why this woman was still driving at all.

Between 2006-2008, Boyd received seven tickets for moving violations in Chesapeake and Virginia Beach (four speeding tickets, one following too closely, one disregarding a highway sign and one reckless driving).

According to Virginia Beach City officials, if a city driver accrues eight demerit points on their license, the employee's director is notified.

Boyd, who was hired in 2007, racked up a total of 14 demerit points on her license after she was hired.

No charges were ever filed against Boyd.

A few days after Knockett was killed, Virginia Beach Commonwealth’s Attorney Harvey Bryant’s office released the following statement: “The law requires specific elements which must be met before criminal charges should be brought. Criminal cases must be proved beyond a reasonable doubt. Negligence is not a crime, although it may be the basis for civil liability... Whether civil liability exists is not something my office determines...”

Immediately following the deadly incident, Deputy City Manager Dave Hansen told the press that Knockett had been sleeping in a “depressed area,” and the truck driver could not see him.

Hansen’s statement gave the impression that Knockett was lying in a pit, or was lying flat on the ground, making it difficult for the driver to have seen him.

However, a few days later, a photo surfaced which was taken by a tourist visiting Virginia Beach, and clearly showed the man sitting on a flat part of the beach in a chair, covered in a bright blue blanket. The photo was taken, just minutes before his death.

The image captured by Joan Veronie of Topeka, KS, told a much different story of the circumstances leading up to the tragic accident, from the one told by city officials.

Once the press published the photo, Hansen apologized for his previous statement.

Despite a Freedom of Information Request, the City of Virginia beach has refused to release the 911 call, placed after Knockett was run over.

The way the city continues to handle the death of Michael Knockett, leads to more questions than answers.

Woman who falsely accused Duke Lacrosse Team of rape, back in jail

On Thursday, Crystal Gail Mangum landed back in the Durham County Jail for violating a release agreement stemming from an arrest earlier this year.

In February, Mangum was arrested for the assault and attempted murder of her boyfriend, Milton Walker, 33, among other charges.

According to police, Mangum set his clothes on fire, physically assaulted him, attempted to stab him, all in view of her three children, ages 3, 9 and 10. The 911 call was actually placed by one the children.

She initially gave the responding officers a false name, "Marella Mangum," and allegedly fought with the officers.

Mangum was charged with attempted first-degree murder, five counts of arson, assault and battery, communicating threats, three counts of misdemeanor child abuse, injury to personal property, identity theft and resisting a public officer.

While Mangum became famous for the false allegations she made against the Duke Lacrosse Team, she has a history of criminal behavior, and making allegations of rape.

In 1996, two months after her graduation from Hillside High School in Durham, N.C., Mangum went to the police and claimed that she had been raped three years earlier and identified her attackers as her boyfriend and two of his friends. In 2006, CNN reported that the police interviewed Mangum and asked her "to write a chronological-order statement for investigative purposes."

She originally told police that her three alleged attackers had held her against her will, raped her, and threatened her life. However, she failed to follow up with police after the initial interview and simply dropped the charges.

Late in 1996, Mangum joined the U.S. Navy, signing on for an eight year enlistment. She began active duty in 1997. Though committed for eight years, the Navy discharged her in 1998.

In 1997 at age 19, she met and married a 33 year old illiterate man named Kenneth Nathaniel McNeill. Under Navy orders, her and her new husband moved to California, where she was assigned to the USS Mount Hood. While aboard the Mount Hood, she began a sexual affair with another sailor. She became pregnant as a result of the affair and eventually had another child with the sailor.

The U.S. Navy has refused to disclose the reason for Mangum's abrupt discharge.

Because of the extra-marital affair, Mangum and Kenneth McNeill became separated. On June 16, 1998, she filed charges against McNeill in which she claimed that he had taken her into the woods and threatened to kill her. A hearing on the matter was held on June 23, Mangum failed to appear in court to prove the charges and the complaint was dismissed.

After a string of low-wage jobs, Mangum decided to enter the world of stripping. She showed up one evening in 2002 at the Diamond Girls strip club in Durham. Club owner Larry Jones said that she was looking for a job and auditioned by giving lap dances to several men.

Jones decided not to hire Mangum because she was "acting funny."

One of the men she entertained with a lap dance was a taxi driver. According to a Durham County Sheriff's report: "As she was feeling him up and putting her hands in his pockets she removed the keys to his taxi cab, without him knowing. He [the cabbie] told her he would drive her home but needed to go to the restroom first. While in the restroom he was advised that she was driving off in his taxi cab."

Durham County Deputies went looking for Mangum and when they tried to stop her, she sped away driving the wrong way on U.S. Highway 70. They quickly caught up with her in a wooded area, as deputies approached the vehicle she aimed the car at one of them and attempted to run him over. She was finally apprehended after hitting one of the sheriff's cars. Mangum passed out while being questioned by deputies and was transported to Duke University Medical Center. Her blood alcohol level was .19 (more than twice the N.C. legal limit).

That incident resulted in Mangum's conviction on the following charges: -larceny -speeding to elude arrest -assault on a government official -DUI

She received a sentence of three consecutive weekends in the Durham County Jail and two years probation.

Eventually, Mangum landed a job as a stripper at a club known as Platinum Pleasures. She was also working for an escort service called Bunny Hole Entertainment. After the Duke rape allegations, she told a reporter with The News and Observer that she went on dates with clients (johns) about three times a week.

While no DNA of any Duke Lacrosse player was found on Mangum, the DNA of her boyfriend and habitual DUI offender Matthew Murchison was found. She also told police that she had engaged in sexual intercourse with two other men close to the time she erroneously reported the rape. The other two men were Jarriel Johnson of Raleigh, and Brian Taylor of Durham. They both worked as drivers for the escort service, taking her to parties and 'dates.'

Mangum had the benefit of a rather unscrupulous district attorney in Mike Nifong, who apparently took her lies and ran with them. Nifong was in the midst of a re-election campaign at the time she made her false allegations and used the case in an attempt to persuade the black community to support his campaign.

The case brought national attention to Nifong and stirred-up racial tensions in the Raliegh-Durham area. Jesse Jackson and Al Sharpton both joined in the public persecution of the Duke students, even the Black Panthers came to town looking for trouble.

Eventually, the truth prevailed, charges against the students were dropped, and Nifong was discredited and forced to step down. He was ultimately disbarred for his actions in the case and spent one night in jail for lying to a Superior Court judge.

Unfortunately, due to Mangum's false allegations of rape, innocent women will suffer, as sexual assaults continue to be the most under-reported crimes. Victims already feel humiliated and are often hesitant to risk further character attacks from criminal defense attorneys, and often decide not to report the heinous crime. Undoubtedly, Mangum's selfish actions have made the very painful process of coming forward to prosecute attackers even more difficult.

Virginia Beach Sheriff says local cops questioning immigration status "ridiculous"

Speaking to the Virginian-Pilot on Attorney General Ken Cuccinelli’s recent legal opinion that police officers across the state of Virginia can inquire into the immigration status of anyone they encounter during the course of an investigation, Virginia Beach Sheriff Ken Stolle said: “It's really a ridiculous issue.”

Sheriff Stolle continued: “Why would a police officer be asking that? And what does he do if they refuse to answer?”

Of course, for Virginia Beach law enforcement, immigration enforcement is quite a touchy issue.

The city’s de facto ‘sanctuary policy’ came to light in 2007, when two teenaged girls were killed by a drunk-driving illegal alien with a long arrest record.

In April 2007, in Virginia Beach, Va., a Mexican national named Alfredo Ramos slammed into the rear of a vehicle in which Allison Kuhnhardt and Tessa Tranchant were stopped while waiting at a traffic light. Ramos, 22 was traveling at a high rate of speed and was drunk at the time (he blew a .14 BAC). The two high school students had to be cut from their crumpled car and both later died after being taken to the hospital. Ramos suffered only a busted lip.

Though an illegal alien, Alfredo Ramos had been living in Virginia Beach for quite a while and worked at local a Mexican restaurant known as Mi Casita. Ramos had been previously convicted of three separate charges of public intoxication, identity theft, and even a DUI, but continued to live in the area. He speaks only Spanish and required an interpreter at all of his court proceedings.

The girls which Ramos killed were ages 16 and 17. Tessa Tranchant's brother Dylan had only been home from Iraq for two weeks, when his sister was killed. Dylan was tasked with identifying his little sister's body. The case gained national fame thanks to the reporting of Fox News' Bill O'Reilly, who helped expose Virginia Beach as a haven for illegal aliens.

O’Reilly placed the spotlight on that city's Mayor and Police Chief and characterized the resort town as a place where drunken Mexican invaders are allowed to roam freely.

Immediately after the case was reported on the O’Reilly Factor, Virginia Beach Police Chief Jake Jacocks went on the offensive and claimed that O'Reilly was wrong in focusing on the fact that Ramos was an illegal alien. He accused the Fox News commentator of turning the girls' deaths into a "political issue."

However, local ABC affiliate WVEC showed that the police chief was at least culpable in the tragedy when they reported that "Chief Jacocks says the policy of not reporting illegals until after three DUI charges was his idea. He hoped it would let illegal immigrants feel comfortable if they were involved in an accident."

Former Mayor Obendorf told reporters: "I never want anyone to miss the fact that someone who was drunk caused the death of two innocent young women, and it had nothing to do with nationality or anyone doing anything inappropriate as far as the government is concerned."

While the leadership of Virginia Beach has never formally declared the city to be a 'sanctuary' for illegal aliens, the way the leadership of Chicago or Tucson have done, it is every bit the haven to invaders that those two cities represent. Virginia Beach is dominated by hotels, restaurants, and housing developers, all of which hire tremendous numbers of illegal aliens.

Hotel owners often declare that they could simply not operate without the influx of Mexican and Central American nationals who can frequently be seen passed out drunk on the beach during the summer. The city has also seen thousands of over-priced cookie cutter homes built in the last several years, most of which have been constructed by illegal Mexican labor.

The building boom turned local convenience and home improvement store parking lots into gathering spots for groups of often drunken Latino men. While the city is very happy raking in huge profits in increased real estate taxes, they pass precious little of that revenue on to the citizens. While having a population of 450,000 residents, Virginia Beach still relies solely on a volunteer rescue squad for medical emergencies.

While city leaders bristled in 2007, at his accusations, Bill O'Reilly got it right. I live here and I am a daily witness to the unlawful transformation of this once beautiful city.

In December, 2009, two illegal aliens (Alberto Fuertes Loredo and Isidor Loredo Amaya) were charged with murder. When I initially called the Virginia Beach Correctional Facility and asked a deputy about the immigration status of Loredo and Amaya, I was put on hold for quite some time. When the young man came back on the line, he directed me to another deputy. When I called that number and received no answer, I started the process over again.

I was then told that whether or not ICE had placed a hold on the two was “privileged information” and he could not tell me. In fact, until I pressed him, he would not even tell me whether or not the Mexican nationals had been formally charged.

Despite the deputy’s insistence, the suspects’ immigration status is public information, but it was obvious he was only following orders from his superiors.

The rise in crime in Virginia Beach that can be attributed to illegal aliens is no doubt embarrassing to city officials. However, unless the city begins to take seriously the threat posed by the illegal aliens they have welcomed…They will continue to be asked uncomfortable questions as that city’s death toll rises.

I would invite Sheriff Stolle to tell Tessa’s parents, Ray and Collette Tranchant, that he thinks enforcing immigration laws is “ridiculous.”

Norfolk Circuit Court Judge Karen J. Burrell personally delivered that above message to Michael McLeod on Friday, when she sentenced him to five years in prison for killing his neighbor’s dog.

In 2003, McLeod told police that he shot his neighbor’s dog, Rex, a Labrador Retriever, because he woke him up with his barking.

An Army veteran, he aimed his .22-caliber rifle with a scope at the dog across the street, and fired one shot. McLeod planned the shooting, even taking the time to cut back shrubbery from around his bedroom window “for a clear shot.”

The 7-year-old dog was hit and killed.

McLeod pleaded guilty to animal cruelty charges, but fled before sentencing. He has been on the run until a traffic stop in Florida revealed his outstanding bench warrant. He has been in the Norfolk City Jail since May.

While the sentence may seem unusually long to some, Judge Burrell reminded the courtroom that the dog was “a living creature.”

McLeod received four years for animal cruelty and an additional year for for failure to appear.

McLeod cried after Burrell announced the sentence.

This sentencing sends a strong message to anyone who would consider harming an animal in the city of Norfolk.

Virginia Attorney General gives police okay to question immigration status

19 comments Subscribe

Virginia Attorney General Ken Cuccinelli has issued a legal opinion stating that police officers across the state can question the immigration status of anyone they encounter during the course of an investigation “so long as they don't extend the duration of the stop by any significant degree.”

Cuccinelli gave the opinion at the request of state Del. Bob Marshall, who represents Prince William County.

In October 2009, the Prince William Board of Supervisors is met to discuss and implement a new directive from Immigrations and Customs Enforcement. The new orders were designed to weaken the very successful 287g program, which gives local law enforcement the power to enforce immigration laws.

InsideNova.com obtained the federal document ordering the changes. It reads:

"[Immigration and Customs Enforcement] has made changes to the Memorandum of Understanding (MOA), terminating the original agreement and requiring execution of a new and revised MOA.”

The new agreement also stated that "ICE must give approval for an immigration arrest where no state or local charges are made [and] ICE must give prior approval of planned operations where immigration enforcement is the sole function." Another revision "provides levels and types of criminal offenses that ICE directs to be a focus, rather [than] pursuing immigration enforcement based on specific charges.”

In other words, the Obama administration is trying to tie the hands of law enforcement in Virginia’s Prince William County, the same way they have done so in Arizona’s Maricopa County, telling Sheriff Joe Arpaio to back off.

The fact is, the 287g program has been extremely successful and instrumental in cleaning up Prince William County, which has been over-run with illegal aliens as well as the problems they bring…which is precisely why Obama wants to eliminate it.

Last month, Cuccinelli joined with eight other attorneys general from across the nation in drafting a letter of support for Arizona’s SB1070. Of course, Clinton-appointed U.S. District Judge Susan Bolton recently blocked the new law.

Just like the good people of Arizona, Virginians have had enough of the federal government’s refusal to enforce immigration laws.

Execution date set for Virginia's only female death row inmate

On Thursday, a September 23 execution date was scheduled for Theresa Wilson Lewis. In 2003, she pleaded guilty to masterminding the October 2002 murders of her husband and stepson in Pittsylvania County.

In early June, the 4th U.S. Circuit Court of Appeals decided against Lewis, Virginia’s lone female death row inmate.

In March, her lawyers told the federal appeals court that her death sentence should be rescinded because her drug addiction and alleged personality disorders were not considered at her trial.

At her 2003 sentencing, Circuit Court Judge Charles Strauss addressed Lewis, telling her that she was a cold, emotionless killer, and was motivated solely by financial reasons. She was actually given two death sentences, plus 53 years.

Prosecutors said that Lewis boasted to friends that she had married Julian Lewis Jr., simply for money and offered sex to the two men who carried out the murders. She was to be the sole beneficiary of $250,000 in insurance money.

Lewis, not only offered herself to the hired hit men, but her 16-year-old daughter as well. She left a door unlocked, and sat by as her husband and stepson were gunned down, waiting an hour to call 911.

Both men were shot multiple times with shotguns.

In a scene which can only be described as sickening, Lewis actually went through her husband’s pockets, as he lay dying, gasping for air.
A deputy sheriff testified that when he arrived on the scene, Julian Lewis was still alive, and told him: “My wife knows who done this to me.”

The gunmen, Rodney Fuller and Matthew Shallenberger, were both sentenced to life in prison. Shallenberger committed suicide in 2006 at Wallens Ridge State Prison.

Lewis' daughter, Christie Lynn Bean, who knew about the plot but kept quiet, also served time in prison.

Lewis’ current attorney, James Rocap, claims that his client was not capable of plotting the murders due to her severe dependency on prescription drugs, as well as a personality disorder which rendered her overly dependent on men.

He also says that Lewis has developed a “deep faith and deep remorse for the crimes.”

Rocap says he is planning to appeal the case to the Supreme Court, as well as file for clemency with Gov. Bob McDonnell. He told reporters: “We were obviously disappointed in the result and intend to vigorously pursue all avenues on Teresa's behalf.”

If executed, Lewis will be the first woman to die in Virginia’s death chamber since 1912, when 17-year-old Virginia Christian died in the electric chair, after smothering her elderly employer with a pillow.

Since 1900, only 50 women have been executed in the United States, with the last one taking place five years ago in Texas.

Since the reinstatement of the death penalty in 1976, Virginia has carried-out 107 executions.

13-year-old boy murdered in Chicago...shot 22 times

In what appears to be a case of mistaken identity, on Wednesday night, a 13-year-old boy was shot at least 22 times by a masked gunman. The killer emerged from a darkened, overgrown vacant lot and pumped round after round into rising eighth-grader Robert Freeman Jr. while he was riding his bike.

The boy's father, Robert Freeman Sr., told the Chicago Sun-Times: "My son was the only one got hit. I don't understand how no one seen anything."

As usual, witnesses are not cooperating, and this murder is likely to go unsolved. Chicago is suffering a wave of gang violence which was responsible for nearly all of the city’s 458 murders last year.

The following is the number of murders which have taken place in Chicago since 1990.

1990: 851
1991: 927
1992: 943
1993: 931
1994: 929
1995: 827
1996: 789
1997: 759
1998: 704
1999: 641
2000: 628
2001: 666
2002: 647
2003: 598
2004: 448
2005: 449
2006: 467
2007: 442
2008: 510
2009: 458
2010: 253 (as of July 29)

Since January 1, 1990, an astonishing 13, 867 people have been murdered in Chicago. Even worse, many of the victims have been children as young as 10.

The following lists the number of children murdered during the corresponding school years:

2006-2007…31
2007-2008…27
2008-2009…36

Here locally, Newport News is experiencing a surge in murders this year due to gang violence as well. While the numbers are not even close to those being seen in Chicago, two 9-year-olds have been shot in the city this year, with the latest coming on Tuesday in a drive-by shooting.

Fortunately, that boy survived.

Just as in Chicago, Newport News police have been frustrated by the “no snitching” code which keeps dangerous criminals on the streets, and their neighbors who refuse to identify themâ€"prisoners in their own homes.

On Wednesday, a fed up Newport News Police Chief James Fox pleaded with the residents of the East End community where most of the shooting have taken place, to work with them.

Chief Fox said: "Give us some information about who is doing the shootings. It helps us get that little piece of the puzzle to get that person off the street."

Will D.C. sniper Lee Malvo get the death penalty after all?

Police in Montgomery County, Maryland have now opened an investigation into the claims that convicted sniper Lee Boyd Malvo made in an interview with a psychiatrist, that he and his accomplice actually had more victims than authorities believed.

During last week’s A&E special on the 2002 D.C. shootings, psychiatrist Neil Blumberg said Malvo admitted to him that he and John Allen Muhammad committed 42 shootings. To date, Montgomery County police are only aware of 27 shootings carried out by the pair.

Montgomery County police spokeswoman Lucille Baur told the Associated Press that detectives plan to speak with Blumberg, as well as interview Malvo about the claims.

If Malvo’s claims prove to be true, it is certainly possible that he could be executed just as was, his fellow sniper Muhammad.

On November 10, 2009, with all of his appeals exhausted and Gov. Tim Kaine (D-VA) refusing to intervene, convicted D.C. sniper John Allen Muhammad was executed at the Greensville Correctional Center in Jarrat, VA.

In August 2009, the U.S. 4th Circuit Court of Appeals denied Muhammad’s final appeal in his conviction and sentencing for his role in the 2002 DC area shooting spree. Among his many victims, one was a 13-year-old boy who was walking to school.

While Muhammad’s life ended in Virginia’s death chamber, his willing accomplice Lee Malvo, who admitted to targeting “as many white people” as they could kill, was spared a date with he executioner.

The decision by a Chesapeake, Va. jury just two days before Christmas 2003, to spare the life of convicted murderer Malvo proved to be perfect timing for the defense.

Undoubtedly, had the sentencing phase taken place after Christmas, Malvo would now be sitting on death row.

Had Judge Jane Marum Roush sequestered the jury, thus not allowing their heartstrings to be tugged on by all of the sights and sounds of the season, the families of those gunned down by that savage killer would now be sleeping a little easier. It is standard practice in a high-profile trial, to isolate the jury and it certainly was warranted in this important case.

While many of the victims' families expressed disappointment in the jury, the judge arguably deserved just as much criticism. As this case wound down and the Christmas holiday neared, Judge Roush should have isolated that jury.

Malvo and Muhammad committed more than two dozen murders (and maybe many more) throughout Virginia, Maryland, Georgia, Alabama, Louisiana, Arizona, and Washington D.C. For those crimes, Malvo has never expressed any remorse, he, actually laughed when he told police officers how he chose his unwitting victims and how much damage the Bushmaster rifle caused to their bodies.

As far as the familes of his victims are concerned, Malvo does not deserve sympathy, he, in fact, deserves the same fate he gave to his victims.

One of the victims was Lori Ann Lewis-Rivera, who was shot to death by Malvo while standing outside of a Kensington, MD gas station. Her mother, Marion Lewis said of Malvo’s sentence: "I'm very disappointed in the American justice system. Our society has now been sentenced to the responsibility of seeing to this man's health and welfare for the next 30 or 40 years, and that's unconscionable."

Paul LaRuffa of Clinton, Md. survived an attack from Malvo and Muhammad. He spoke with reporters immediately following the jury's decision and said: "There were two people who did the ultimate crime. One got the ultimate penalty and one didn't. I ask you why?"

Could it be the "made for TV” Christmas specials, the lights, the trees, the carols, the ever-present Salvation Army bell ringers?…All of those things contribute to filling our hearts with the "Christmas spirit". That is the time of year which we tend to take stock of ourselves, and of how perhaps we should atone for our indiscretions.

The approaching holiday and the feeling of forgiveness that many of us feel during the twelfth month of the year, seem to have had a great influence on that jury's decision.

By sentencing Malvo to life, the jury may have made it easier on themselves to settle in for a long winter's slumber and enjoy the holiday with their loved ones. However, it undoubtedly made an already tough time for the victims' families and the few survivors of Malvo's vicious attacks, even worse. These people have to live with the knowledge that Malvo's parents can still speak to their son, while their innocent children, parents, siblings, and friends lie dead.

They must also live with the knowledge that as long as he is alive, there is a chance that he could be released. It is not out of the realm of possibility that in 15 or 20 years, with the right governor, Malvo could walk out of prison.

Since Virginia only allows their governors to serve one term, there would be no concern of voter backlash for a very liberal governor to release Malvo.

While it may seem implausible now, there is precedent for such an irresponsible decision.

Though she received a life sentence, Manson family member and attempted presidential assassin Lynnette “Squeaky” Fromme was recently released from prison, after spending 34 years behind bars. At the time of her sentencing, no one could imagine a scenario in which she would leave prison alive either.

One day, when Lee Boyd Malvo is in his 40’s and his crime spree has been long since forgotten by the public, he will undoubtedly place all the blame for the murders he committed, squarely upon the shoulders of his dead accomplice (In fact, he already has.), and claim that he is no longer the confused and angry young man he was in the fall of 2002.

With this new investigation, the possibility arises that Malvo’s victims will finally receive some measure of justice. At the very least, it may ensure that he will actually spend the rest of his life in prison.

On July 28, George Cole, 76, a greeter at the Walmart in the Tanglewood Shopping Center, took a bathroom break around 9:30 p.m. That’s when he was brutally assaulted and robbed.

According to police, Charles Everett Williams, 19, was waiting in that bathroom for a victim.

In addition to the beating, Williams also allegedly stole the $23 in Cole’s wallet, leaving him on the floor, where he remained for some time.

Williams was taken to Albemarle Hospital where he was treated for several injuries, including a concussion.

Williams, who was arrested in the parking lot, is charged with robbery, assault inflicting serious injury, possession of stolen goods and possession of drug paraphernalia. He is currently being held in the Albemarle District Jail on $75,000 bond.

Elizabeth City Police Lt. John Etheridge said: “Mr. Cole was found in the bathroom at Walmart bleeding. He had been punched in his face twice, both eyes. And his mouth was also bleeding. He was there for quite a while.”

Etheridge went on to describe what led them to Williams’ capture, saying: “[A] citizen reported they knew who it was, got in touch with him and he came back to the scene. He came back to the scene and that's how we made the arrest."

Cole, now recovering from his injuries at a co-worker’s house, described the ordeal, saying: "I remember going to the restroom on my break, that was around 9:30 at night. And from then on I don't know...I woke up in the ambulance. They were helping me in the ambulance.”
