Male nurse admits to raping disabled man in Newport News nursing home

On Wednesday, Junious Boyd Batten, 42, pleaded guilty to raping a 55-year-old mentally disabled man who was in his care. The multiple assaults took place between 2006-2007 at the Cote de Neige Home for Adults in Newport News.

As part of an agreement with prosecutors, Batten pleaded guilty to one count each of forcible sodomy, non-forcible sodomy and abuse and neglect of an incapacitated adult. He could receive life in prison, when he is sentenced on July 23.

According to court documents, the assaults took place when Batten ordered his victim to get undressed, and lie face down on the bedroom floor.

In March 2008, the victim testified: “He got on top of me and ... do something wrong, something he (was not) supposed to be doing.”

Batten also admitted to sexually assaulting a 24-year-old man who lives at the nursing home. The victim reported the abuse to a counselor.

In 2008, he testified against Batten, saying: “He did a lot of sick, twisted things, having me pull my pants down while he masturbated.” Batten also forced him to watch as he performed sexual acts in front of him with another man.

In May 2009, a jury awarded the family of the disabled man $750,000 in damages, after they filed suit against Cote de Neige. According to the lawsuit, Batten was charged with 13 crimes before and during the time he was employed by the nursing home.
